This Terms and Conditions ("Agreement" or "User Agreement") is a contract between you and AT Pacific, Inc. and applies to your use of the FXRemit.com foreign exchange remittance service and any related products and services (collectively the "Service"). This Agreement affects your rights and you should read it carefully. We encourage you to print the Agreement or copy it to your computer's hard drive for your reference. In this Agreement, "you" or "your" means any person or entity using the Service ("Users"). Unless otherwise stated, "FXRemit.com," "we", "us" or "our" will refer collectively to AT Pacific, Inc. and its subsidiaries, affiliates, directors, officers, employees, agents and contractors.

By clicking "I Agree", "I Accept"; or by submitting payment information through the Service you agree to the terms and conditions of this Agreement, the FXRemit.com Privacy Policy, and any documents incorporated by reference. You further agree that this User Agreement forms a legally binding contract between you and FXRemit.com, and that this Agreement constitutes "a writing signed by You" under any applicable law or regulation. Any rights not expressly granted herein are reserved by AT Pacific, Inc. This Agreement is subject to change by AT Pacific, Inc. without prior notice (unless prior notice is required by law), by posting of the revised Agreement on the FXRemit.com website. You may review the current Agreement prior to initiating a transaction at any time at our Terms & Conditions page.

I. General Conditions

By registering for the Service, you appoint FXRemit.com as your agent to process remittance on your behalf in accordance with your instructions, subject to the terms and restrictions of this Agreement. You acknowledge that (i) FXRemit.com is not a bank and the Service is a foreign currency remittance service rather than a banking service, and (ii) FXRemit.com is not acting as a trustee, fiduciary or escrow with respect to your funds, but is acting only as an agent and custodian.

Our online foreign exchange remittance service requires registration from the customers by clicking the registration link/button and providing the information required. The use of the information collected is gverned by our Privacy Policy. Upon registration, the user may use the services. For subsequent use, registered users will only need to fill out the recepient or beneficiary information, amount, destination & delivery options and payment options.

1. Payment of remittance by credit card requires credit card verification. To avoid fraud and protect credit card holders, it may become necessary for a phone call or email to be made to the user. Users agree to use the correct contact numbers and verification information. Our inability to contact the users or cardholders might result in suspension of the remittance.
2. To assure accurate and efficient delivery, the users agree to provide accurante and complete information and details of the recipient or beneficiary of the funds.
3. FXRemit.com has the option to deliver the funds thru door to door delivery or telegraphic transfer depending on service availabilty for a certain area. A service fee shall be charged the appropriate services that apply for every single transaction entered into by the user. Deliveries within Metro Manila shall be made within 24hours after credit card verification and approval or after the receipt of funds from your bank, provided that one Philippine banking day is within the 24-hour period.
4. For credit card remittances, there shall be no minimum amount that needs to be remitted.
5. The current Dollar to Peso exchange rate as posted in the FXRemit.com website will be used to convert your funds to Peso. This will be updated daily .
6. No deliveries will be made during Philippine holidays and on conditions of force majeur.
7. Remittance service once placed, is non-is non-reversible and non-refundable.

II. User Responsibilities

Each Remitter must register online to avail of the FXRemit.com remittance service and must also read and agree to the terms and conditions of this Agreement, including:

1. Users must provide us with true, complete and accurate information. Users must be at least 18 years of age, of sound mind and a holder of a valid credit card (users using credit card to fund their remittance) with correct billing address information matching the registered address in FXRemit.com.
2. Users agree that we may charge the FXRemit.com service fee to his credit card.
3. You agree not to engage in behavior that could reasonably be construed as providing yourself a cash advance from your credit card, and agree not to assist Users who engage in behavior that could reasonably be construed as providing themselves a cash advance from their credit cards. Such behavior includes, but is not limited to, a User sending a beneficiary or recepient with a credit card-funded remittance through the FXRemit.com, then receiving the funds back from the beneficiary or recipient and attempting to withdraw the funds from their account. We reserve the right to reverse all such transactions and to terminate any accounts that are associated with such behavior.
4. Users agree not to use email addresses of FXRemit.com customers to send unsolicited email. You agree not to use unsolicited email, usenet, message board postings, or similar methods of mass messaging (spam) to gather referral bonuses. The use of spam to promote the Service has strict negative consequences. We will immediately and permanently terminate the account of any User who has sent unsolicited email targeting FXRemit.com users to gain referrals or for any other purpose. In addition, you may be subject to state and federal penalties and other legal consequences under applicable law if you send unsolicited email. Our Anti-Spam Policy is intended to protect our users, the Internet, and us.
5. Users agree to provide true, complete and accurate information about his intended Beneficiary. If the information provided is inaccurate or incomplete in any way, such user agrees to hold FXRemit.com free and harmless from any delay in delivery, error in delivery or failed delivery.
6. Users consent to have their name and email addresses made available to FXRemit.com and its partners, subsidiaries and affiliates to facilitate efficient remittance and delivery of money.
7. Users are fully responsible for all remittances made over the FXRemit.com website. Once a remittance is made, such remittance becomes final and irreversible. Any disputes arising between User and FXRemit.com with respect to a remittance duly entered shall not be our responsibility.
8. Users agree that all remittances initiated in which charges are made to their credit cards are final and not reversible. Users also agree that they will not charge back any amount previously charged to their credit card by FXRemit.com. If a user charges back a credit card charge for a payment initiated by him, FXRemit.com may recover the amount of the charge-back by re-charging user's credit card for the amount of the charge-back.
9. Users agree not to divulge their passwords to anyone else, nor may they use anyone else's password. We are not responsible for losses incurred by users as the result of the misuse of passwords.
10. Users agree not to use FXRemit.com services for other purposes including, but not limited to hacking, tampering, modifying or otherwise corrupting the security or functionality of our services. Users found guilty will be subject to damages and other penalties, including criminal prosecution if necessary.
11. Users agree to indemnify and hold FXRemit.com, its affiliates, officers, directors and employees free and harmless from any claim or demand whatsoever relating to or arising out of the remittance service where such claim or demand results from Users' negligence or wilfull misconduct.
12. This Agreement is governed by the laws of the Territory of Guam or any applicable US Federal law.

II. Duties and Responsibilities of FXRemit.com

1. FXRemit.com reserves the right to verify any information provided by a Remitter and to request additional information as it may determine in its sole discretion.
2. FXRemit.com shall not be responsible for payments made to unintended Beneficiaries due to the input of incorrect, misleading or inadequate information by Remitters.
3. FXRemit.com shall exercise its best efforts to ascertain the identity of the Beneficiaries.
4. FXRemit.com reserves the right to hold funds beyond the normal delivery periods undertaken for transactions it deems, in its sole discretion, to be illegal, wrongful or improper.
5. FXRemit.com, in its sole discretion, may terminate this Agreement, access to its website, or access to the remittance service without prior notice and for any reason whatsoever and at any given time.
6. FXRemit.com retains all right, title and interest in and to its trademarks, patents and tradenames. Remitters shall only use FXRemit.com, FX Ventures or FXPay trademarks with the express permission of AT Pacific, Inc. Users shall not use the trademarks in any manner that is damaging to the AT Pacific, Inc. services.
7. FXRemit.com, in its sole discretion, reserves the right to change, modify or terminate this Agreement at any time and for any reason whatsoever.
8. No deliveries will be made on legal Philippine holidays and conditions of force majure.
